Understanding Children and Young People’s Mental Health
The Equality Act 2010 offers protection from discrimination at work when a mental
health problem is defined as a disability, and the charity Mind has a helpful leaflet
explaining more about this law and protection against discrimination at work.
This Act says that an employer may not ask questions about health before offering a
job to someone, and this is to prevent discrimination on the grounds of health-related
problems. Once the job is offered however, they can ask health-related questions and
a person may be offered the job ‘conditionally’, that is to say subject to satisfactory
references or disability checks.
