Information, Advice or Guidance
Depending on the type of organisation and level you are working in, it is extremely
likely you will have your own professional code; examples include doctors, teachers
or the police. It is vital that you follow the code and, given the importance of
confidentiality, you obtain legal advice if you are unsure as to whether to disclose
confidential information.
It is best practice when dealing with clients to ensure you have a confidentiality
policy in place that deals with this issue. It should contain a statement explaining
that you have a duty to report certain situations or disclosures should it be necessary.
Be sure to bring this to the client’s attention should you feel the conversation is
heading that way.
Key Facts
• Always seek legal advice before breaking client confidentiality
• Ensure your clients know in advance that, in some circumstances,
you have a duty to inform others.
